1. Acceptance of these Terms

Creating a Rentorius account requires affirmatively accepting these Terms. You must be at least 18 years old and able to form a binding contract to use Rentorius. If you use Rentorius on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

2. What Rentorius is (and isn't)

Rentorius provides a platform for Hosts and Renters to find each other, agree on a rental, and pay for it. Rentorius is not a party to the rental agreement formed between a Host and a Renter, does not own, inspect, or guarantee the condition of any listed item, and is not a warehouse, common carrier, or insurer except where a specific protection program (Section 7) expressly says otherwise.

3. Accounts & eligibility

• You are responsible for the accuracy of the information on your account and for keeping your login credentials secure.
• One account per person. You may not create an account for someone else, or transfer your account to another person.
• Hosting certain categories of items, enabling Instant Book, and withdrawing earnings may require completing identity verification.
• Rentorius may suspend or terminate an account that violates these Terms, provides false information, or is used fraudulently.

4. Host responsibilities

As a Host, you agree that:

• You own the item you list, or have the legal right to rent it out.
• Your listing accurately describes the item's condition, included accessories, and any usage restrictions.
• The item is safe and fit for its intended use for the duration of the rental.
• You will honor confirmed bookings, including Instant Book reservations, absent a legitimate reason covered by Rentorius's cancellation policy.
• You are responsible for any applicable taxes on your rental income.

5. Renter responsibilities

As a Renter, you agree that:

• You will use a rented item only as intended and in accordance with the Host's stated rules.
• You are responsible for the item from pickup (or delivery) until it is returned to the Host in the condition it was received, normal wear and tear excepted.
• You will return the item by the agreed end date, or arrange and pay for an extension through Rentorius before the rental period ends.
• You will report any damage, malfunction, or safety issue to the Host and to Rentorius as soon as reasonably possible.

6. Bookings, payments & fees

Booking an item authorizes a charge for the daily rate, applicable delivery fee, a service fee, tax, and the cost of the protection tier selected at checkout. Instant Book listings confirm immediately; other listings require the Host's approval before a charge is finalized. Rentorius may adjust its service fee structure from time to time; the fees shown at checkout are the fees that apply to that booking.

7. Damage protection

Every booking includes Basic damage protection, covering the item for accidental damage during the rental up to a stated limit. Renters may upgrade to Premium protection at checkout for broader coverage, including theft, fire, and weather-related damage, up to a higher stated limit. Damage protection is not an insurance policy, does not cover intentional damage, gross negligence, use in violation of the Host's rules, or loss the Renter fails to report, and any claim is subject to review before a payout, deduction, or waiver is issued.

8. Cancellations

Cancellation terms are shown at checkout before a booking is confirmed. In general, a Renter who cancels with reasonable advance notice is eligible for a refund of the rental cost less any service fee already incurred; a Host who cancels a confirmed booking may be subject to a penalty and reduced visibility on the marketplace. Repeated last-minute cancellations by either party may result in account restrictions.

9. Prohibited items & conduct

You may not list or rent illegal items, weapons or ammunition, hazardous materials, stolen property, or anything requiring a license or permit you do not hold. You may not use Rentorius to harass, discriminate against, defraud, or misrepresent yourself to another user, or to circumvent Rentorius's payment system for a transaction arranged through the platform.

10. Identity verification

Rentorius may require government ID verification before a user can enable Instant Book, list certain categories of items, or withdraw earnings. Rentorius uses a third-party verification provider for this purpose and handles the resulting data as described in Rentorius's privacy practices.

11. Disclaimers & limitation of liability

Rentorius is provided "as is." To the fullest extent permitted by law, Rentorius disclaims all warranties, express or implied, regarding the platform or any listed item, and Rentorius's aggregate liability arising out of your use of the platform will not exceed the greater of the fees you paid to Rentorius in the twelve months before the claim arose, or one hundred dollars.

12. Indemnification

You agree to indemnify and hold Rentorius harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the platform, your listing or rental of an item, or your violation of these Terms.

13. Disputes & governing law

These Terms are governed by the laws of the state in which Rentorius, Inc. is incorporated, without regard to conflict-of-law principles. Before filing a claim against Rentorius, you agree to first contact Rentorius support so we can attempt to resolve the issue informally.

14. Changes to these Terms

Rentorius may update these Terms from time to time. If a change is material, Rentorius will provide reasonable notice before it takes effect. Continuing to use Rentorius after a change takes effect means you accept the updated Terms.
